Terms and Conditions

Sea Leggs Coastal Tours, LLC (“Company,” “we,” “us,” or “our”) provides guided boat tours and related recreational activities. By booking, boarding, or participating in any tour or activity operated by Sea Leggs Coastal Tours, LLC, you (“Guest,” “you,” or “participant”) acknowledge that you have read, understood, and agreed to the following Terms and Conditions.

1. Assumption of Risk

You understand and acknowledge that boating and water-related activities involve inherent risks, including but not limited to rough waters, weather changes, marine life, slips and falls, equipment failure, and the actions of other vessels or participants. You voluntarily assume all risks, known and unknown, associated with participation in any Sea Leggs Coastal Tours activity.

2. Release of Liability & Waiver

To the fullest extent permitted by law, you hereby release, waive, discharge, and hold harmless Sea Leggs Coastal Tours, LLC, its owners, officers, employees, captains, crew, agents, and affiliates from any and all claims, demands, damages, losses, costs, or expenses arising out of or related to:

  • Personal injury, illness, disability, or death
  • Property damage or loss
  • Negligence (except where prohibited by law)
  • Acts of God, weather, water conditions, or marine wildlife

This waiver applies whether the claim arises before, during, or after participation.

3. Indemnification

You agree to indemnify and defend Sea Leggs Coastal Tours, LLC from any claims, liabilities, damages, costs, or attorney fees arising from:

  • Your participation in a tour or activity
  • Your violation of these Terms and Conditions
  • Your actions causing harm to yourself or others

4. Safety Guidelines & Guest Conduct

Sea Leggs Coastal Tours, LLC prioritizes the safety and enjoyment of all guests. By participating in any tour, you agree to comply with the following safety and conduct guidelines:

  • Life Jackets: All children under six (6) years of age must wear a properly fitted U.S. Coast Guard–approved life vest at all times while onboard. Parents or guardians are responsible for ensuring compliance.
  • Alcohol & Behavior: Alcohol is permitted only for guests 21 years or older; the captain has full authority to limit or prohibit alcohol consumption. Disruptive, unsafe, or illegal behavior may result in removal from the vessel without refund.
  • Safety Instructions: Follow all instructions from the captain and crew, including boarding, disembarking, and emergency procedures.
  • General Conduct: Horseplay, unsafe movement, excessive noise, or disregard for other guests’ comfort or safety is prohibited.
  • Medical & Fitness: Guests participate at their own risk and must disclose any medical conditions that may affect safety or participation.

Failure to adhere to these rules may result in removal from the tour without refund and the company will not be liable for any resulting incidents.

5. Medical Fitness & Responsibility

By participating, you certify that you are physically and mentally fit to engage in boating activities. You are responsible for disclosing any medical conditions that may affect your safety. Sea Leggs Coastal Tours, LLC is not responsible for medical expenses, emergency treatment, or medical outcomes.

In the event of an emergency, you authorize Sea Leggs Coastal Tours, LLC to obtain medical treatment on your behalf, at your own expense.

6. Alcohol, Drugs & Behavior

Alcohol is permitted on board for guests twenty-one (21) years of age or older; however, Sea Leggs Coastal Tours, LLC does not sell, serve, or provide alcohol. Consumption of alcohol by guests under the age of 21 is strictly prohibited.

Guests may not participate while under the influence of illegal drugs or excessively intoxicated. The captain reserves full authority to limit or prohibit alcohol consumption at any time for safety reasons.

Sea Leggs Coastal Tours, LLC reserves the right to refuse service, remove guests, or terminate a tour without refund due to unsafe, disruptive, illegal, or intoxicated behavior.

7. Alcohol Liability Waiver & Assumption of Risk

By bringing, possessing, or consuming alcohol on board, you acknowledge and agree that:

  • You do so voluntarily and entirely at your own risk
  • You are legally permitted to consume alcohol under all applicable federal, state, and local laws
  • You assume full personal responsibility for your actions, behavior, judgment, and alcohol consumption
  • You will not engage in unsafe behavior, including swimming, boarding, disembarking, or moving about the vessel while impaired

You expressly understand and agree that the captain, crew, vessel owner, and Sea Leggs Coastal Tours, LLC have no duty to monitor, limit, or control your alcohol consumption, and shall not be held responsible for the consequences of such consumption.

To the fullest extent permitted by law, you hereby release, waive, and hold harmless Sea Leggs Coastal Tours, LLC, the vessel owner, captain, crew, employees, agents, and affiliates from any and all liability, claims, demands, damages, injuries, losses, fines, penalties, or legal actions of any kind arising directly or indirectly from alcohol possession or consumption.

This waiver applies regardless of whether such claims arise from negligence, lack of supervision, failure to intervene, or any other cause, except where prohibited by law.

8. Weather, Wildlife & Environmental Policy

All tours are subject to weather, sea, and environmental conditions. The captain has absolute authority regarding route changes, timing, destinations, delays, or cancellations for safety or operational reasons.

Sea Leggs Coastal Tours, LLC makes no guarantees regarding wildlife sightings, including dolphins or other marine life. Wildlife encounters are unpredictable and depend on natural conditions beyond our control.

Environmental Responsibility: Guests must respect marine and coastal ecosystems, including mangroves, sandbars, and protected areas. Guests must not harass, feed, or disturb wildlife. All interactions are at the guest’s own risk.

Sandbars & Stops: Guests must follow crew instructions regarding landing on sandbars or other shallow areas.

Sunset visibility and quality are not guaranteed. A “perfect sunset” is dependent on weather conditions, cloud cover, visibility, and environmental factors. No refunds will be issued based on lack of wildlife sightings or sunset conditions.

Guests acknowledge that Sea Leggs Coastal Tours, LLC is not responsible for wildlife-related incidents, environmental damage caused by guests, or lack of wildlife sightings.

9. Cancellation & Refund Policy

All cancellations must be made at least twenty-four (24) hours prior to the scheduled departure time to receive a full refund.

Cancellations made less than 24 hours before departure, no-shows, or late arrivals are non-refundable.

Sea Leggs Coastal Tours, LLC reserves the sole right to cancel, delay, shorten, or modify a tour due to weather, sea conditions, mechanical issues, Coast Guard advisories, or any safety-related concern. In such cases, guests will be offered a full refund or the option to reschedule at no additional cost. Decisions regarding weather and safety are made at the captain’s discretion and are final.

10. Property & Personal Belongings

Sea Leggs Coastal Tours, LLC is not responsible for lost, stolen, or damaged personal items brought on board, including phones, cameras, clothing, or other valuables.

11. Photography & Media Release

By participating, you grant Sea Leggs Coastal Tours, LLC permission to use photographs or video taken during tours for promotional, marketing, or social media purposes without compensation.

12. Minors

Minors must be accompanied by a parent or legal guardian, who assumes full responsibility and liability for the minor’s participation and behavior.

Children under the age of six (6) years are required to wear a properly fitted U.S. Coast Guard–approved life vest at all times while on board, in accordance with U.S. Coast Guard and Florida boating safety regulations.

Sea Leggs Coastal Tours, LLC provides U.S. Coast Guard–approved life vests; however, parents or legal guardians may choose to bring their own approved life vest. The parent or legal guardian is solely responsible for ensuring proper fit, usage, and compliance for the minor.

13. Governing Law & Venue

These Terms and Conditions shall be governed by the laws of the State of Florida. Any legal action must be brought exclusively in a court of competent jurisdiction within Florida.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

15. Safety Acknowledgment & Acceptance of Terms

By booking a tour online, signing a waiver, checking a confirmation box, or boarding a vessel, you acknowledge and agree that:

  • You have read and understood these Terms and Conditions
  • You understand the inherent risks of boating and water-related activities
  • You agree to comply with all safety instructions given by the captain or crew
  • You accept responsibility for yourself and any minors in your care, including compliance with life vest requirements
  • You understand and agree to the 24-hour cancellation policy and refund terms
  • You understand and agree to the Wildlife & Environmental Policy, including no guaranteed wildlife encounters and environmental responsibility

Your booking confirmation, electronic acceptance, checkbox acknowledgment, or participation constitutes a legally binding acknowledgment, assumption of risk, and agreement to all policies.

16. Booking Confirmation & Checkbox Agreement Language

The following language may be used during online booking or checkout:

“By completing this booking, I acknowledge that I have read and agree to the Terms and Conditions, understand the inherent risks of boating activities, accept the 24-hour cancellation policy, and understand the Wildlife & Environmental Policy. I accept responsibility for myself and any minors in my care.”

17. Cancellation & Weather Policy Summary (FAQ Use)

  • What is your cancellation policy? Cancellations must be made at least 24 hours before departure to receive a full refund.
  • What happens if I cancel within 24 hours? Cancellations within 24 hours, no-shows, and late arrivals are non-refundable.
  • What if weather is bad? If Sea Leggs Coastal Tours cancels due to weather or safety concerns, you will receive a full refund or the option to reschedule.
